Court dismisses claim of age discrimination
Margaret McCarthy was 53 years old when she was terminated by USA Credit Union in Macomb County. She was replaced by a woman aged 36. She sued for age discrimination and retaliation, alleging that the Defendant's management referred to her as an "old bully" who needed to find a different type of job more appropriate to her age. The Court of Appeals characterized the latter statement as a "stray remark" and summarily dismissed McCarthy's lawsuit. It also ruled that she had provided no foundation for upholding the retaliation claim.
