Court reverses trial judge who required unreasonable proof of discrimination
Gary Daugherty sued the City of Toledo for race discimination after his employment as manager of the Environmental Services Division was terminated. He had complained that he was underpaid, given that his [white] predecessor AND HIS CURRENT SUBORDINATE both earned a higher salary. The District Court imposed proof requirements beyond those required under the so-ocalled McDonnell Douglas framework and summarily dismissed Daugherty's claim. The Sixth Circuit reversed and reinstated the claim.
