Kentucky Attorney General joins fight against FedEx misclassification of drivers
This week, the Kentucky Attorney General filed suit against FedEx, seeking a court ruling that the company misclassifies its employees as "independent contractors" in order to deny them legislative protections including workers compensation insurance, unemployment insurance and wage and hour protection. Numerous other states have already taken the same action against FedEx, noting that its mis-classification of employee drivers results in the shift of normal, legislated employer burdens to employees and tax-payers. UPS, which classifies its employees properly, termed the issue one of basic fairness, noting that it faces unfair competition when FedEx is allowed to thumb its nose at legally-enacted worker protections.
