Nurse's Fair Labor claim is dismissed
This week the Sixth Circuit dismissed Margaret White's Fair Labor Standards Act case against her employer hospital. It also upheld the decertification of her class action. The Court held that since White did not fully comply with the hospital's rules governing payment for work required during unpaid lunches, she could not maintain an action against the hospital for deducting one-half hour for unpaid lunch from every shift.
