Auto Owners' claim of non-liabilty in boating death is upheld
Brian Lepp caused the death of Kathleen O'Neill while operating a large, fast watercraft. He had insured the boat with Progressive Insurance Company and had attempted to buy umbrella coverage through AutoOwners. He and his agent disagreed over the attempt to buy coverage and whether the agent had informed him that the boat was not covered. The Court of Appeals held that under the circumstances, Lepp had not proved that the agent had undertaken the duty to provide umbrella coverage on the boat.
