Broe v. Allstate: Allstate wins battle with unlicensed head-injury treater
In this dispute between an unlicensed provider and Allstate Insurance Co., Allstate ultimately persuaded a jury that the provider did not adequately document and prove the medical care it provided. At Allstate's request, based upon evidence relating to several individuals, the company was forced to repay all of the PIP benefits it had received. Earlier,Allstate's summary disposition motion was denied where Allstate opposed the provider's motion with only conclusory affidavits disputing the allegations of the provider's complaint.
