Contract action based on UCC and "implied covenant of good faith" is dismissed
The Michigan Court of Appeals affirmed a Wayne County judge's dismissal of a contract action that was based on an "implied covenant of good faith and fair dealing." The judges noted that the pertinent section of the Uniform Commercial Code dealing with the sale of goods and implying such a duty has never been recognized by the Michigan judiciary. They also upheld the dismissal of AIJ Property, LLC's claim of "tortious interference with a business relationship" against Comerica Bank, since AIJ failed to produce evidence of an improper motive for Comerica's actions.
