Court applies venue restrictions to all "tort" actions, regardless of remedy sought
This week, the Court of Appeals issued a conflict-resolution procedure-based opinion deciding whether cases based on "tort" or negligence/wrong-doing principles should be subject to the venue rules, even if the plaintiff was not seeking "damages for personal injury, property damage or wrongful death." The judges unanimously held that regardless of the legal theory pursued or the remedy sought, if actions contained a claim based in tort principles, the venue statute would apply and the action must be pursued where the "injury" occurred.
