This week the Court of Appeals affirmed a decision dismissing the fraudulent misrepresentation claim of Appleway Equipment Leasing, Inc., against River City Equipment Sales and Craig Scholten. The Court ruled that since Appleway suffered only economic damages, it could not not sue for damages. "[W]here a purchaser's expectations in a sale are frustrated becsuse the product he bought is not working properly, his remedy is said to be in contract alone, for he has suffered only 'economic' losses."
