Court holds unsolicited "formulary" faxes are not prohibited unsolicited advertisements
This month, the Sixth Circuit threw out a case brought against defendant-Medco Health Solutions by Sandusky Wellness Center. The Court ruled that the pharmacy's sending of faxes that "merely listed the drugs" available was not an "advertisement" under the Telephone Consumer Protection Act. So now anyone can fax you their "informational" junk without running afoul of the Act. Must be they don't get this kind of junk in courthouses.
