Court of Appeals overturns dismissal of PIP action against Allstate
Charlene London sued her insurer, Allstate, alleging that it did not pay proper PIP benefits to her son, Deon London. Allstate brought a motion for summary disposition, which the court took under advisement. While the parties were waiting for a decision by the Court, the case was dismissed for "no progress." The Londons appealed, arguing that a case cannot be dismissed for failure to conduct discovery when the parties are awaiting a decision by the court on a motion for summary disposition. In a brief opinion, the Court of Appeals agrreed unanimously.
