Court reaffirms principle that unlicensed contractor may not sue homeowner
Southeastern Tile, LLC, sued Phillip Pierce and Sherri Pierce, after placing a lien on their home, when a contractor wrote the company a bad check to cover sub-contracted tile work. The homeowners argued that Southeastern lacked the capacity to sue them, because neither the general contractor, nor Southeastern was a licensed building contractor. The Court agreed and upheld an award of $12,000.00 in attorneys fees and costs incurred by the homeowners.
