Court rejects argument that Michigan medical malpractice rules violate HIPAA patient rights
The Michigan Court of Appeals summarily rejected an appeal by Rebecca Williams Jackson and affirmed the dismissal of her malpractice case against Obstetrics and Gynecology of Big Rapids and others. The Court concluded that Mecosta County Medical Center would not be held accountable for injuries caused to Jackson because she was too slow to file suit with an accompanying Affidavit of Merit. Jackson sought a ruling that some of the procedural protections provided to healthcare providers denied patient rights guaranteed by the Health Insurance Portability and Accountability Act.
