Court upholds summary disposition of claim by condo association
In Woodlore Condo Assoc. v. Zinchuck, the Court of Appeals affirmed the trial judge's summary disposition of a claim that the defendant former owners were guilty of breach of fiduciary duty and fraudulent misrepresentation. The Court conceded that one of the allegedly fraudulent acts occurred within the statutory limitation period, however, it ruled that the plaintiff did not adequately document that damages resulted from that mis-deed, and therefor summary disposition was proper.
