Disabled miner denied "black lung" benefits because he applied too late.

The Peabody Coal Company successfully avoided paying a 20-year miner any benefits because he didn't file suit quickly enough after being diagnosed as disabled by shortness of breath.  The miner, a man named Brigance, was unaware of the potential "Black Lung" statutory benfits and did not file a lawsuit within three years of his original diagnosis.
