Fraud claim arising out of building purchase is dismissed due to Plaintiff's non-compliance in discovery.

The Kdian Family Group bought a building in Wayne County through financing by the Monroe Bank & Trust, Micahel Irvin and Brent Beshears.  Within four months, the family sued the latter three defendants for fraud  and misrepresentation, arguing that they deliberately failed to disclose the condition of the property and various buildilng defects.

The Defendants attempted to depose Azzia Abdullahi, the president of the family corporation who had signed the Complaint and the underlying purchase documents.  She refused to appear in Michigan for a deposition even after ordered by the Court to appear within 30 days. Ultimately the Court dismissed the plaintiff's  case for wilfully failing to comply with discovery, and the higher Court deemed this an appropriate exercise of judicial discretion.
