Girlfriend of "womanizer" cannot sue the guy for intentional infliction of emotional distress
Denise Ketchmark sued Archie L. Hayman, claiming that he strung her along in a manner that intentionally inflicted emotional distress. Her claim was summarily dismissed by the trial judge and she appealed. The appellate court agreed with the trial judge's assessment that the womanizer's conduct was not so "atrocious and utterly intolerable" as to demonstrate a basis for a lawsuit. While the Defendant may never have intended to marry the Plaintiff, and may have lied about the exclusivity of the relationship, neither of these facts warrants a lawsuit under Michigan law. The Court also agreed with the trial judge that proofs about HPV virus were not strong enough to support an "intentional infliction of emotional distress" cause of action.
