Injury claim against school volleyball coaches is dismissed
Felicia Krol suffered a fractured vertebra during a pushup exercise conducted by the Dryden Community Schools volleyball coaches during tryouts. She sued the coaches, and in an attempt to avoid the impact of governmental immunity, she claimed that the coaches were guilty of gross negligence, since governmental actors have immunity for ordinary negligence. The lower court and the Court of Appeals both rejected the argument that any conduct of the coaches would constitute "gross negligence" and dismissed Krol's injury claim.
