Injury victim's case dismissed for failure to provide discovery
This week the Court of Appeals upheld the dismissal of an injury victim's claim after the defendant argued that he failed to provide adequate discovery responses to Interrogatories and Requests to Produce. The case is Markabani v. Al-Rekabi. The attorneyh for Markabani argued that a lesser sanction would be appropriate; the trial judge and Court of Appeals ruled that Markabani did not provide an adequate explanation for his complete failure to comply.
