Maker of generic digitalis sued after manufacturing glich results in toxicity

Actavis Totowa LLL, a New Jersey subsidiary of an Icelandic manufacturer of generic drugs, has been named in several product liability suits after it was disclosed that deviations from good manufacturing practices had resulted in double-thickness tablets containing as much as two times the active ingredient of the heart drug, Digitek.  Claims have been filed in New Jersey, California and West Virginia, including one wrongful death claim.  No claims have been filed in Michigan, and it is possible that no claim can be filed in Michigan, since the Michigan Legislature granted broad immunity to drugs approved by the FDA.  Some victim's attorneys believe that the broad grant of immunity will not cover drugs which were manufactured with an inherent flaw, however, that theory has not been tested before the victim-hostile majority of the Michigan Supreme Court.
