Malpractice claim dismissed as Court deems the victim's expert "unreliable" under tort "reform" rules
Carol MacKenzie sued John D. Koziarski and his medical practice on behalf of the Estate of Therel Kuzma. She maintained that the surgeon mismanaged Kuzma's laparascopic surgery, causing his death. The surgeon hired by Kuzma's family "focused on inguinal hernia repair" which is related to the surgery Koziarski perfromed, but not identical. He also tesitified that he had not read the legal pleadings for the case or the entirety of the medical records. On this basis, the Court dismissed him as an expert and dismissed the wrongful death case.
