Michigan Supreme Court rules boating statute does not create duty to passengers
In Binno v. Binno, Bencivenga and Dabish, the Michigan Supreme Court issued a peremptory order holding that boating safety rules governing the operation of recreational vessels do no not create a duty running from the operator to boat passengers. The only ramification of the ruling is the denial of injury victims' (such as the family of deceased passenger Ryan Binno) right to sue the operator for negligent statutory violations.
