Owner and lessor-bar operator dispute insurance proceeds after tenant theft

In the Wayne County case Pal-O-Mar Bar, IV, Inc. v. Badger Mutual Insurance, the trial judge was required to sort out which party was entitled to the insurance proceeds resulting from a tenant operator's theft of fixtures.  Ultimately, the judge concluded, after a bench trial, that certain items attached to the real property belonged to the owner of the property and interim lessor appealed.  The Court of Appeals agreed with the judge that there was not sufficient evidence to support the lessee-sub lessor's claim of ownership.
