Parochial school may deny admission based upon disability
In Winkler v. Marist Fathers of Detroit, Inc., the Court of Appeals ruled that it is not illegal for parochial schools to discriminate based upon a disability. The judges held that religious organizations enjoy the First Amendment right to refuse to provide services on any basis they choose, regardless of public policy or statutory law. "Any further inquiry by civil courts" into the basis of a denial of 'religious or educational activities' is prohibited.
