Pipefitter suffering from asbestos-related cancer cannot sue
Earl Falk was a pipefitter for many years and suffered many years of exposure to asbestos-containing products. He first became aware of the cancer risk at a union meeting that occurred in the 1980s. He acquired a lung disease in 1993, but was not diagnosed with asbestosis. In 1999, he was diagnosed with lung cancer, and in 2006 he was again diagnosed with an unrelated lung cancer. This time he filed a law suit against various manufacturers of asbestosis-related products. The Court of Appeals upheld the dismissal of his case because the judges determined that his statute of limitations ran in 1999, barring his claims.
