Prisoner left hand-cuffed in solitary has claim for cruel and unusual punishment
Jasen Baker failed to stand for the 4:00 p.m. "count" at London Correctional Institute. As punishment, he was moved to solitary, and left hand-cuffed in an awkward position for 12 hours (until the following morning). He sued, alleging a violation of the 8th Amendment's prohibition on "cruel and unusual" punishment, and the Sixth Circuit ruled that the claim must go to trial.
