Sixth Circuit examines jurisdiction issues involving "long arm" statutes
In Scott D. Gerber v. James C. Riordan and Seven Locks Press Corp., the Sixth Circuit analyzed the due process issues involved in forcing a non-resident to respond to a tort or contract claim in another state. The case ultimately turned on issues of general appearance by an attorney to defend the lawsuit, and all three judges agreed that when the defendants appeared to defend the case on its merits, they waived any objection to jurisdiction issues.
