Sixth Circuit upholds dismissal of developers' Fair Housing Act claim against City of Ann Arbor
This week the federal appellate court upheld the dismissal of an action brought by HDC, LLC and other developers who claimed that the City of Ann Arbor had violated the Fair Housing Act by imposing conditions in a demolition permit that were impossible for the developers to meet. The developers argued that the City imposed the impossible condition in order to prevent the development because it would have included accommodations for handicapped patients. The Sixth Circuit ruled that the developers did not support their claim with credible evidence.
