Tenant's anti-lock-out case is reinstated
This past week the Court of Appeals reinstated a tenant's Circuit Court action against his landlord for locking him out of his apartment. MCL 600.5701 prohibits landlords from the self-help option of locking a late-payment tenant out of his apartment. In Anderson v. White, the tenant sued for damages after a lock-out, but the Circuit Court judge ruled that he lacked subject matter jurisdiction to hear the case. The Court of Appeals rejected the Judge's ruling and reinstated the action.
