Venue of malpractice case moved to location of death from location of treatment

Judge Kirsten Kelly enjoyed a good day on Friday when injury victims lost all three cases she participated in deciding.  One was a malpractice claim against Zia O. Farooki and several other physicians and medical entities including the DMC.  The family of Michael Grekowicz sued Michael's cardiologist and other treaters who failed to include an implanted ICD (defibrillator) in Michael's pacemaker after diagnosing a cardiac irregularity soon after Michael's birth.  He died of sudden cardiac arrest in Macomb County shortly after a car accident.

The Court ruled that the proper venue for Michael's wrongful death case was Macomb County, where his heart stopped, rather than in Wayne County where the allegedly defective treatment was provided.
