Woman cannot establish oral contract to pay after signing written release
Jodi Newhouse sued James Sturrus, her former stepfather, alleging assault and other claims arising out of alleged sexual abuse beginning when she was 11. She had sued Sturrus previously and her claim was resolved by payment of $15,000.00 and the execution of a Release. She sued again, several years later, alleging that Sturrus had breached an oral contract to pay additional compensation, which she claimed he had partially fulfilled. The Court relied upon the written Release to dismiss Newhouse's newer complaint, holding that her claims of an oral agreement were contradicted by the writing she had signed.
