Woman loses forgery lawsuit after her witness list was not served on Defendant
Barbara Smith sued several defendants alleging that she lost her home as a result of a forged signature on a deed. She was unable to call any witnesses at the trial, however, because the witness list she filed with the court was never served on the Defendants. The Court of Appeals upheld this result, noting that because of Smith's failure to effect service, the Defendants were unable to identify her witnesses until the week before trial.
