Wrongfully arrested man is entitled to jury trial on claim against police detective

As the statute of limitations approached on a child pornography case, the involved State Police detective apparently rushed to make an arrest and caused the wrong man to be arrested.  The victim of the arrest filed a lawsuit, arguing that the detective was guilty of gross negligence in rushing to seek an arrest without confirming the perpetrator's identity.  The Court held that the wrongfully arrested man had presented sufficient evidence to survive summary disposition.
